Update on the AGA, the American Public Gas Association (APGA) and the National Propane Gas Association (NPGA) U.S. Supreme Court Challenge to the DOE Gas Furnace and Gas Commercial Storage Water Heater Minimum Efficiency Standards.
Twenty-one states and 10 organizations, including the National Association of Home Builders and the National Apartment Association, joined a petition by AGA, APGA and NPGA asking the Supreme Court to review the federal appeals court ruling that upheld a Biden-era DOE rule blocking the production of non-condensing natural gas furnaces and certain commercial water heaters. The petition challenges a 2-1 decision by the U.S. Court of Appeals for the District of Columbia Circuit and argues the rule effectively eliminates a category of widely used natural gas appliances. Additional information on the status of the petition and the organizations who filed amicus briefs in support of the petition is available in today’s AGA’s press release here. We will provide updates on this issue as they develop.
