Congressional Review Act (CRA) Approved by Congress, Will Address Concerns with the DOE Efficiency Standards for Gas-fired Instantaneous Water Heaters (GIWH) Final Rule.
We have been reporting on the status of, and the concerns with, the DOE efficiency standards for gas-fired instantaneous water heaters (GIWH) including the introduction of the Congressional Review Act (CRA) resolution to address those concerns. Back on February 27, the US House of Representatives passed H.J. Res 20 providing for congressional disapproval of the rule submitted by the Department of Energy relating to ‘‘Energy Conservation Program: Energy Conservation Standards for Consumer Gas-fired Instantaneous Water Heaters’’. (See February 28, 2025 Update on End Use Codes and Standards.) Yesterday, congress approved the CRA resolution that overturns the Biden Administration’s instantaneous gas water heater rule (GIWH), sending it to the President for his signature. Upon his signature, the DOE efficiency rule for GIWH’s will be voided immediately, and any future DOE action will be prohibited from issuing a substantially similar rule unless Congress expressly authorizes it.
