Back on December 27, 2024, we reported that the DOE published the Federal Register Notice with the Final Rule that adopted amended standards for gas-fired instantaneous water heaters less than 2 gallon and greater than 50,000 Btu/hour, at an efficiency level that requires condensing technology. In last week’s Update on End Use Codes and Standards, we also reported that AGA had joined 21 State Attorney Generals, GIWH manufacturer Rinnai, as well as other national and state trade associations challenging this DOE instantaneous gas water heater rule that bans non-condensing GIWH’s in the 11th Circuit. Related to this court action, yesterday, Sen. Ted Cruz introduced the resolution in the Senate, supported by AGA and a number of other organizations ( Press Release attached) outlining the support for the resolution to repeal this DOE final rule. We will be providing updates on the legal process and any DOE activity regarding this important GIWH issue that may result in changes to the minimum efficiency requirements for GIWH’s as well as other gas appliance minimum efficiency regulations that the DOE is responsible for evaluating.
