DOE Issues a Confirmation of Effective and Compliance Dates Pertaining to Standards for Residential Cooking Products.

As a reminder, on June 7, 2024 we provided the DOE February 14, 2024 Federal Register Notices on both the Direct Final Rule (DFR) and the Notice of Proposed Rulemaking (NOPR) for Consumer Cooking Products Including Gas Cooking Tops and Ovens. As outlined in the Federal Register Notices, the comment deadline on the NOPR was Tuesday, June 3, 2024. Recall that for gas cooktops, DOE established a minimum efficiency requirement of a Maximum Integrated Annual Energy Consumption (IAEC) IAEC to 1770 kBtu/year. According to that Federal Register, “if an adverse public comment(s) is filed by June 3, 2024 the Secretary then decides if there is a reasonable basis for withdrawing the direct final rule under based on DOE’s criteria for prescribing new or amended standards under the 42 U.S.C. 6295(o) and 42 U.S.C. 6313(a)(6)(B), e.g., technologically feasible and economically justified.”  Today, DOE has determined that the adverse comments received in response to the direct final rule do not provide a reasonable basis for withdrawing the direct final rule. Therefore, DOE has issued this Federal Register notice to confirm the effective and compliance dates of these standards:

The effective date of June 13, 2024, for the direct final rule published on February 14, 2024 (89 FR 11434) is confirmed. Compliance with the standards established in the direct final rule will be required on January 31, 2028.

According to the Federal Register Notice, DOE reports that the minimum efficiency requirements for residential gas cooking products, “ 97 percent of gas cooking tops and 96 percent of gas ovens”  will already meet or exceed the standards by the first year of compliance, 2028. All residential gas and electric residential cooking products must meet or exceed the minimum efficiency requirements starting on January 31, 2028.
