Preliminary Review of the Public Comments Submitted on the 2027 Edition of the National Fuel Gas Code (NFPA 54,/ANS Z223.1).

As discussed in last week’s Update on End Use Codes and Standards,  AGA staff is in the process of reviewing the attached Public Comments and Committee Input on the National Fuel Gas Code (NFGC) that will be discussed at the October 7 – 9, 2025 second draft meeting of the NFGC committee, to be held at the Charleston Marriott in Charleston, SC. Attached is a preliminary review by AGA staff of the some of the proposals with the exception of the Manual of Style changes for each chapter that are still being reviewed to help ensure that those changes are editorial and do not modify or negatively impact the purpose of the provisions in each chapter.  As a reminder, BECS Committee members are also requested to review and provide feedback to us on the proposals by September 15th.  

Update on the AHAM First Amendment Lawsuit on the Colorado Gas Stove Emissions Labeling Legislation.

In the August 15 Update on End Use Codes and Standards, we reported on the Association of Home Appliance Manufacturers (AHAM) filed motion for injunctive relieve from the Colorado gas stove labeling bill.  Colorado House Bill 1161 was signed into law in June that “ requires retailers of gas stoves to affix a “yellow adhesive label” that reads “UNDERSTAND THE AIR QUALITY IMPLICATIONS OF HAVING AN INDOOR GAS STOVE.” The label must also include a URL or QR code to a webpage created by the state’s health department that provides “credible, evidence-based information on the health impacts of gas-fueled stoves “.  This week, Kelly Mariotti, President and CEO of AHAM provided the attached update on the litigation including access to a one-pager titled “AHAM Constitutional Challenge to Colorado HB-1161” included in the update that provides additional details on the first amendment lawsuit and the status and next steps as this litigation moves forward.  Note that in response to the AHAM filed motion request on enforcement of the rule, the Court approved the stay of enforcement of the law on August 14. We will provide updates on this important issue as it moves through the courts.
